Dear Deadly Haiku,

Last night, I appeared on MSNBC's Verdict with Dan Abrams to discuss Karl Rove's outrageous refusal to appear before Congress regarding serious allegations that he used the US Justice Department to take down a prominent Democratic politician. It is alleged that Mr. Rove personally instigated the prosecution of former Alabama Governor Don Siegleman. The case has been criticized by legal experts, and 52 former state attorney generals – both Republicans and Democrats – have criticized the case and called for an investigation. If Rove refuses to testify voluntarily and ignores the subpoenas that will certainly be issued, he should be held in Inherent Contempt of the House of Representatives.

No American is above the law. None of us should be able to ignore Congress without consequence. If Mr. Rove ignores a subpoena from the Judiciary Committee, then the House of Representatives should pass an Inherent Contempt citation and exercise our right to send the House Sergeant-of-Arms to gather Mr. Rove and bring him before Congress to testify.

I do not advocate this option lightly, but the reality is that Congress has few options left against an Administration that totally refuses to submit to any type of reasonable Congressional oversight. Congress has both the right and obligation to investigate these matters. Never before has an Executive so upset the checks and balances inherent in our Constitution. If we back off or delay, we effectively forfeit the power of Congress to investigate the Executive branch.

Rove is not the first White House official to ignore Congress. We have seen a pattern of refusals based on laughable claims of executive privilege. First, White House Chief of Staff Joshua Bolten and former White House Counsel Harriet Miers ignored subpoenas on the investigation into the firing of US Attorney Generals for partisan political motives.

Their refusal to testify was unprecedented: never before have executive officials totally refused to even show up before Congress. Bolten and Miers are the highest officials ever held in contempt of Congress. Unfortunately, Attorney General Mukasey – in a dereliction of duty – has refused to enforce the contempt decree and now Congress is suing them in District Court to demand compliance. Then, the Vice President's Chief of Staff, David Addington, refused to testify on the investigation into the Bush Administration's ordering of torture. Now, Rove continues this executive arrogance by also refusing to testify.

Enough is enough. We have a Constitutional obligation to provide accountability to a White House that is trying usurp the constitutional powers of Congress.

These are the very reasons why I have been pushing for impeachment hearings for Vice President Cheney. The Bush Administration has been running roughshod over the Constitution for eight long years. We should not allow the promise of a positive election be used as an excuse to ignore our duty to investigate crimes that weaken the very fabric of our Democracy.

Pickles Bush: FORGET KATRINA, Myanmar junta failed to warn people on cyclone

WASHINGTON - US First Lady Laura Bush accused Myanmar's military rulers Monday of failing to warn their citizens in time about a killer cyclone and pressed the junta to accept US aid in the disaster's wake.

"Although they were aware of the threat, Burma's state-run media failed to issue a timely warning to citizens in the storm's path," Bush said in an unusual appearance at the White House briefing room podium.

"It's troubling that many of the Burmese people learned of this impending disaster only when foreign outlets, such as Radio Free Asia and Voice of America, sounded the alarm," she said. Washington calls the country Burma.

Bush, who has taken a leading role in shaping US policy towards Myanmar, said Washington "stands prepared" to increase its assistance well beyond an initial emergency 250,000-dollar outlay by the US embassy in Yangon.

She declined to give a precise dollar figure, saying the junta first had to allow a US disaster assistance response team into Myanmar to assess the scope of the devastation from Tropical Cyclone Nargis' weekend rampage.

"I can't speak to how large that would be. But I feel assured that it would be substantial, if we can give it," she said, promising help to provide water, sanitation, food and shelter.

Bush made clear any assistance would go through the United Nations or international nongovernmental organizations -- and not directly to a regime under US sanctions for failing to embrace democratic reforms.

"I hope that the military will realize they have to accept aid from everybody they can possibly accept it from. And maybe that will be the something good that can come out of this terrible destruction," she said.

With the official death toll at 10,000 and expected to rise sharply, Bush declared that "the response to the cyclone is just the most recent example of the junta's failure to meet its people's basic needs."

Bush also warned the regime off holding a planned constitutional referendum Saturday and said that US President George W. Bush on Tuesday would sign a law giving imprisoned democracy icon Aung San Suu Kyi the Congressional Gold Medal -- the highest civilian honor that US lawmakers can bestow.

"That's important," said the first lady, who called the award a way to "let the people of Burma know that the United States is standing with them."

She also denounced the referendum, saying the regime "orchestrated this vote to give false legitimacy to their continued rule" and that "it would be very, very odd, I think, if they went ahead."

Laura Bush cited violence against the opposition and noted that Aung San Suu Kyi -- under house arrest for more than 12 of the past 18 years, following her party's sweeping victory in 1990 elections that the junta set aside -- would be barred from holding office under the draft constitution.

"If it proceeds under current conditions, the constitutional referendum they have planned should not be seen as a step toward freedom, but rather as a confirmation of the unacceptable status quo," said the first lady.

"We appeal to China, India, and Burma's fellow ASEAN members to use their influence to encourage a democratic transition," she said, referring to the 10-member Association of Southeast Asian Nations.

At the same time, Laura Bush acknowledged Washington had "only anecdotal" evidence that its sanctions -- which the US president further tightened last week -- were having an effect on Myanmar's leaders.

Asked whether she worried that US aid might not reach Myanmar's people, Laura Bush replied: "I'm worried that they won't even accept US aid."

The source of such concerns was unclear. The head of a UN office that coordinates humanitarian aid said the junta had shown their willingess to accept such aid.

The government-sanctioned massacre of wolves is now under way.

A mere 30 days after the Bush Administration stripped Yellowstone's wolves of their Endangered Species protection, the Northern Rockies have been turned into a killing field.

Thirty-seven wolves are already dead. Hundreds more are being targeted by Wyoming, Idaho and Montana, which have waited years for this chance to put their plans for extermination into action.

But today there is reason for hope: America's best wildlife legal team is riding to the rescue.

Our partner organization, the Natural Resources Defense Council (NRDC) -- and 11 other groups -- filed suit this week in federal court to stop the killing and restore the wolf's desperately needed Endangered Species protection.

The court action comes not a moment too soon. Eyewitness reports of the latest wolf-killing rampage have been heartbreaking to people all over the world who care about wildlife.

On the very day that these wolves lost their Endangered Species protection, a crippled wolf named "Limpy," one of the most photographed wolves in Yellowstone's famous Druid Peak pack, was shot to death when he ventured outside the park.

Another wolf was stalked for over 35 miles by snowmobile before being overtaken and shot. Another was found dead on the side of the highway, his still-warm body torn apart by bullets.

And, tragically, at least four female wolves have been killed just prior to the denning season, which could doom some of the region's wolf pups.

Wolves simply cannot outrun these relentless attacks. Their last, best hope now rests with the life-saving reprieve that NRDC is seeking in federal court.

Court to consider death penalty for child rape

WASHINGTON (Reuters) - The U.S. Supreme Court this week hears arguments about whether the death penalty can be imposed for child rape, taking up for the first time in more than 30 years whether a crime other than murder can be punished by execution.

The nation's highest court has set arguments on Wednesday on whether the death penalty for the crime of raping a child represents unconstitutionally cruel and unusual punishment.

It will be the second major death penalty case heard this year. In January, the justices considered the current lethal three-drug cocktail used in most U.S. executions.

A ruling is expected by late June on the challenge by two Kentucky death row inmates who argued the lethal injection method violated the constitutional ban on cruel and unusual punishment by inflicting needless pain and suffering.

Executions in the United States last year fell to a 13-year low of 42, and have been temporarily halted since the Supreme Court agreed in late September to decide the lethal injection case.

The Supreme Court's review of death penalty-related cases comes amid a growing nationwide debate on capital punishment itself in one of the few democracies that still permit it.

The case involved an appeal by Patrick Kennedy of Louisiana, who was convicted of raping his 8-year-old stepdaughter and sentenced to death.

Of the more than 3,300 inmates on death row in America, Kennedy and another man convicted of child rape in Louisiana are the only two who did not commit murder.

The last execution in the United States for rape occurred 44 years ago.

AGE AT ISSUE

In 1977, the Supreme Court banned executions for rape in a case in which the victim was an adult woman but left open whether child rapists can be sentenced to death.

The Louisiana law was adopted in 1995. In its current version, rape can be punished by death when the victim was under 13 years of age.

At least four other states -- Montana, Oklahoma, South Carolina and Texas -- have similar laws.

Jeffrey Fisher, a Stanford University law professor representing Kennedy, argued that the U.S. Constitution bars imposing the death penalty for rape, regardless of the victim's age.

"Society views capital punishment as excessive punishment for child rape," Fisher said, citing a national consensus and international norms.

"Today no Western nation authorizes the death penalty for any kind of rape," Fisher said, adding that it is allowed in only a handful of countries, including China, Egypt, Jordan, Nigeria and Saudi Arabia.

Juliet Clark, an assistant district attorney in Louisiana, said the death penalty represented a constitutional punishment for raping a child.

"Public outrage over the sexual violation of immature young children by predatory adults is extremely great due to the recognition that these offenders target and harm the most vulnerable members of our society," she said.

She said 14 states and the federal government authorize the death penalty for various offenses other than murder, such as treason, espionage, kidnapping and aircraft hijacking.

Nine states, led by Texas, supported Louisiana, while the American Civil Liberties Union and the NAACP Legal Defense and Educational Fund supported Kennedy.

The two rights groups said a historical consensus existed against the death penalty for rape in the United States, except for Southern states willing in the past to execute blacks, especially those convicted of raping white women and children.

Paul Butler, a law professor at George Washington University, said moderate conservative Justice Anthony Kennedy may hold the decisive vote on the court closely divided between conservatives and liberals.

Kennedy wrote the court's majority opinion in 2005 that abolished the death penalty for juveniles and he joined the majority opinion in 2002 that barred executions of mentally retarded criminals.

Bush: Iraq violence is a 'very positive moment'

The Bush Administration has a history of turning violence into "positives." During the 2006 war in Lebanon, for example, Secretary of State Condoleezza Rice declared the Israeli attack as "birth pangs." "What we're seeing here, in a sense, is the growing -- the birth pangs of a new Middle East and whatever we do we have to be certain that we're pushing forward to the new Middle East not going back to the old one," Rice said.

Iran: The Next War

Even before the bombs fell on Baghdad, a group of senior Pentagon officials were plotting to invade another country. Their covert campaign once again relied on false intelligence and shady allies. But this time, the target was Iran.

Bush is going to leave Iraq for the next president to clean up

"WE'RE not leaving, so long as I'm the President." There in nine words is the exit strategy for the United States involvement in Iraq. Depending on your viewpoint, it's either a commitment or an admission of defeat.

Bush also mentioned the C word. Civil, that is, as in civil war. He was concerned about the shadow it cast. But the US strategy was to "help the Iraqi people achieve their objective and their dreams, which is a democratic society". The tactics to realise that dream were another matter. Cut and run or stay. To go "would be a huge mistake". Not only for the Iraqis. "It's in our interests that we help this democracy succeed. A failed Iraq would make America less secure … It would give the terrorists and extremists an additional tool besides safe haven, and that is revenues from oil sales."

The President then fell over himself. After he said "the terrorists attacked us and killed 3000 of our citizens", a question was asked: "What did Iraq have to do with that?"

Bush: "What did Iraq have to do with what?"

Q: "The attack on the World Trade Centre?"

Bush: "Nothing, except for its part of — and nobody has ever suggested in this Administration that Saddam Hussein ordered the attack … The lesson of September 11 is take threats before they fully materialise." This is the 1 per cent doctrine, enunciated by Vice-President Dick Cheney, which goes that if there's a 1 per cent chance of something happening, treat it as a 100 per cent certainty and respond accordingly. As a point of record, most of the September 11 attackers (6 OF WHICH HAVE BEEN CONFIRMED ALIVE) came from America's great ally in the Middle East, Saudi Arabia.

9/11 Truth Manifesto

12/20/07 "ICH" -- -- For evidence that America’s political system is a criminal conspiracy, open your mind to piles of new analyses that prove beyond doubt that the official 9/11 story is a lie. Years of a bipartisan cover-up of 9/11 lies make it much more than one horrendous past event. It endures in infamy as a symptom of a corrupt and dishonest government.

Every day we pay for what 9/11 and its cover-up have burdened us with, including the costly Iraq war and the erosion of the rule of law and constitutional rights. Power elites have suppressed the truth because they fear what will happen when the public understands that 9/11 was not accomplished solely by foreign terrorists.

Technically sound analyses of what happened at the World Trade Center have unequivocally shown that the official 9/11 story is not credible (www.ae911truth.org). Truth seekers have met their burden of proof; the government has not met theirs. Simply put, controlled demolition brought down three buildings, not fires from the impact of planes on two of them. Not only was the US government involved, it has also conspired to hide the truth from the public. Why? Republican and Democratic politicians and power elites fear that 9/11 truth will remove what little public trust remains in government. The truth will produce political instability, perhaps breaking the two-party stranglehold on our political system. And it should. And it must, if we are to finally obtain the deep political reforms our nation desperately needs.

The decline started before George W. Bush and his criminal co-conspirators accelerated it with their blatant disregard for the rule of law and our Constitution. It will continue, even with a Democratic administration, unless we reform our political system. We must remind Americans that our nation was born in an insurrectionist, populist rebellion against political tyranny – and that 9/11 teaches us that we need a Second American Revolution. We must destroy the domestic Axis of Arrogance of our plutocracy more than fear a foreign Axis of Evil. How?

A vast nationwide grassroots 9/11 truth movement is ignored by the mainstream news media. Its success will be the catalyst for renewing American democracy. It will produce a shock wave that rattles the brains of all Americans: Shock therapy from a truth so powerful and unsettling that Americans finally see the decline of American democracy that allowed 9/11 and its cover-up.

Make no mistake, the 9/11 truth movement holds the future of the United States. We are not subversive “conspiracy theorists” or enablers of foreign terrorism. We are patriotic warriors working to nullify group delusion produced by government propaganda. Dozens of books and websites reveal countless technical contradictions and inconsistencies with the official government 9/11 story and the laws of physics. The weight of the evidence supports one painful verdict: Our federal government played a role, probably through a large “black op.” The “why” is obvious: To justify an unjust war to serve corporate interests and greed.

Here is our opportunity: To make 9/11 the tipping point for American democracy renewal. Our enemies fear that if this movement succeeds, their plutocratic, elitist cabal – the Axis of Arrogance – run by the two-party duopoly will collapse. Corruption keeps our political system stable – truth must clean it up. Instability is the necessary price for restoring democracy.

A Paradigm Shift

9/11 lies have sustained the ruling terrorism-threat paradigm. 9/11 truth must energize a new political-reform paradigm. Patriotism framed as defending the nation against terrorism must be replaced by patriotism focused on repairing American democracy.

Already, status quo protectionists lie about us to defeat our movement. Things will get worse as our movement draws closer to bringing down the corrupt political system. And we are getting closer. Only 16 percent of Americans believe that members of the Bush administration are telling the truth about what they knew about terrorist attacks on the US prior to 9/11, according to a New York Times/CBS News poll. But what people say in polls is not the same as coming out publicly and vociferously for 9/11 truth, or seeing the roots of 9/11 in the decay of American democracy, not merely the actions of a few evil people.

The deceived public must be re-educated to see the arrogant power elites running our national plutocracy as worse than radical Islamic terrorists. Paul Craig Roberts captured the essence of the problem: “Americans think their danger is terrorists. They don't understand the terrorists cannot take away habeas corpus, the Bill of Rights, the Constitution. ... The terrorists are not anything like the threat that we face to the Bill of Rights and the Constitution from our own government in the name of fighting terrorism. Americans just aren't able to perceive that.”

9/11 is a history lesson to inform the nation about democracy decline. As John McMurtry asked, “So which goes - the faith in America’s greatness and goodness in the world, or the facts which disclose the opposite at the very top?” We must always remember that Americans are better than their government. They do not get the government they deserve. They get the government that the rich and powerful impose. That must end.

We confront more than power elites. There is psychological resistance of millions of Americans to painful 9/11 truth – a shameful, “unthinkable” truth about their elected government. Even if they have doubts about the official story, they instinctively recoil and erect mental barriers to block out the full truth. They want to keep believing that they live in a great democracy. They want to believe that when the Bush administration is replaced our democracy will be in good shape again. Hard to accept that 9/11 truth could not have been suppressed this long without the tacit or explicit approval of Democratic politicians and power brokers.

It is as if we are telling children that their parents are mass murderers. Distracted, time-poor, depressed, political disengaged, cynical and insecure Americans do not want to hear that their government had a hand in 9/11. That for years their two-party-controlled government has blatantly lied to them. That thousands of good Americans have died and been terribly injured in a war propped up by the false-flag 9/11 fiction. In sum, that despite elections a vast criminal conspiracy has been so successful for so long. Such thoughts hurt.

Also, political instability is scary to ordinary Americans. But stability based on corruption and lies is destructive. Only when Americans see 9/11 as a political attack (by Americans on Americans) – not solely a terrorist attack (by foreigners on Americans) – will they understand that revealing 9/11 truth must lead to major political reforms. Instability is the cost of democracy renewal.

Here are powerful messages: The collapse of the rule of law is more important than the collapse of buildings. Countless more have died because of 9/11 than on 9/11. The events of 9/11 ultimately are less important than the reasons for and consequences of 9/11.

As John McMurtry said, “[9/11] allowed an illegitimate administration to transmute into America’s patriotic champion at war - above accountability and the rule of law. ‘Defending America from another terrorist attack’ became a political blank check for corporate corruption of government expenditures with impunity, war criminal acts and threats across the Islamic and alternative third world, and attacks on civil rights and commons at home.” All this persists as 9/11 lies persist.

Despite record-low levels of public trust in Congress and the president, too many Americans still believe that elections are the path to major political reforms. Despite a solid history of campaign lies from politicians, and overwhelming belief that the nation is on the wrong track, Americans keep hoping that they can vote their way into a better future. Most Americans do not have a Boston Tea Party mentality. They are unready to revolt despite revolting conditions. Our truth movement must help Americans accept painful truth and its political fallout. We must put all the technical truth discovered by reputable scientists and engineers to work for systemic reforms.

We must do more than oust the official story and obtain a new 9/11 investigation that now has wide support by hundreds of respected Americans (www.patriotsquestion911.com). We must guide Americans into a more patriotic and courageous mental state. We must help Americans become outraged and rebellious, yet also optimistic about major political reforms.

Political Strategy

Success against the power elites running and ruining our nation requires building an army of Americans openly revolting against the two-party corporatist state now in control. The 9/11 truth movement must use political strategies to defeat the status quo political establishment. Here are three actions.

First, with detailed technical analyses unequivocally proving that the official story is false, the movement can draft a bill that might be titled The 9/11 Truth Act of 2008. This proposed federal legislation should be delivered to every member of the House and Senate early next year. It would clarify the investigation: What its scope and objectives must be. What reliable entity, public or private or a combination, must be used. How the public must be given opportunities to present information. What resources must be provided and what time frame must be adhered to.

We must take the initiative and specify exactly what kind of new official 9/11 investigation is necessary, recognizing that professionals in the truth movement have limited resources and cannot address all questions. The 9/11 truth movement itself must define exactly what the first real credible and comprehensive government sponsored investigation must consist of. We can have no confidence in anything that the political establishment might devise to silence our movement. We must tell the public, the media and the political world what is required to reveal the total truth as to what caused, for example, the collapse of three World Trade Center buildings, especially building 7 not even hit by a plane.

Developing and submitting this legislation must then be followed up by all 9/11 groups urging their supporters to bombard Congress with demands for hearings and passage of the bill. This is the way to engage more Americans politically to obtain full 9/11 truth.

However, few politicians’ comments support the truth movement. A rare statement came from presidential candidate Ron Paul. In a radio interview in January, 2007 he said that the 9/11 investigations to date are “more or less cover-up and no real explanation of what went on.” However, later in the year when he became more visible he was asked about the possibility of the official story being orchestrated by the government. He said emphatically “absolutely not.” In another interview, when asked whether he thought 9/11 was an inside job that our government made happen, he responded forcefully “No.” So apparently Paul sees a cover-up but not about the involvement of our government. Would he support legislation for a new investigation?

Thus the second critical political action is this: Proclaim that only politicians that actively support passage of our legislation will earn support in the 2008 elections from the millions of Americans doubting the official 9/11 story. This threat is an absolute necessity. If the legislation is not passed by Congress and signed into law by President Bush, then we must aggressively support a boycott on voting for all Democrats and Republicans in the 2008 federal elections.

Third, all those committed to 9/11 truth should honor what the Founders gave us in our Constitution in case some day Americans lost confidence in the federal government, especially in Congress. That day has arrived. 9/11 was that day. They gave us the option in Article V for a convention of state delegates to propose constitutional amendments. We must see SYSTEM reforms as only achievable through constitutional amendments that Congress will never propose nor achieve through normal legislation.

Congress and the entire elitist political establishment have intentionally denied us a convention for over 200 years. The one and only requirement in Article V has more than been satisfied by over 500 state applications from all 50 states. Enough is enough. Our truth movement should join the effort of Friends of the Article V Convention at www.foavc.org by urging truth group members to join FOAVC. The political establishment fears both 9/11 truth and an Article V convention. We must grasp that 9/11 truth can bring us to the brink of political reforms and the convention is the process to obtain them.

Conclusion

The 9/11 truth movement must also be a political movement – but not in any partisan sense. 9/11 truth can help Americans take back their country. 9/11 truth can end the criminal, corrupt and conniving plutocracy that stole our government and mutilated our democracy.

We must transform 9/11 from a catalyzing event for imperialistic war-mongering to one for democracy renewal. We must convert terrorist-transfixed fear into political reform enthusiasm.

The pursuit of truth is not always the pursuit of happiness – not when the truth hurts. The 9/11 truth movement is not about finding immediate happiness. It is about rebooting American democracy and, after accomplishing that, earning happiness.

Contempt citations on hold as Dems, Bush craft stimulus plan

Last week it was "pretty certain" that House Democrats would quickly move forward with contempt citations against two Bush administration figures who were stonewalling Congress. Then the economy started circling the drain.

The planned citations now appear to be on hold as Congress and the White House work on a bipartisan economic stimulus package, the central tenet of which involves cutting virtually everyone an $800 check.

Democratic leaders and aides tell The Politico that pursuing the contempt citations in conjunction with the stimulus package would "step on their message" of bipartisanship.

The contempt citations against former White House counsel Harriet Miers and Chief of Staff Josh Bolten were approved by the House Judiciary Committee in July after the two ignored subpoenas requiring their testimony on the US Attorney firing scandal.

Democratic aides told RAW STORY last week that House Speaker Nancy Pelosi (D-CA) was about to sent the citations to the full House. The higher priority now appears to be doing something about the US economy, which many fear is nearing recession.

“Right now, we’re focused on working in a bipartisan fashion on [the] stimulus,” House Majority Leader Steny H. Hoyer (D-MD) told Politico, indicating that the contempt vote is not expected for weeks, depending on how quickly the stimulus package moves.

Pelosi and House Republican leader John Boehner are Congress's chief negotiators with the White House in working out details of the $145 billion plan, and the two branches seem to be nearing a deal, according to the Washington Post.

"I left the meeting that I just had in the Cabinet Room with the leadership in the House and the Senate with a very positive feeling," Bush said Wednesday. "All of us understand that we need to work together. All of us understand that we need to do something that will be effective. And all of us understand that now is the time to work together to get a package done."

The president's optimism and work-together attitude on the stimulus package sharply contrasts his administration's approach to Congress's investigation into the firing of nine US attorneys in 2006 that appeared to be politically motivated.

Bush has invoked executive privilege in refusing to allow his current or former aides to testify and withholding documents from Congress, although the administration has also insisted that the president was not directly involved in discussions relating to the firings.

Pelosi supports the contempt citations, although some critics say even those do not go far enough to hold the administration accountable because the Justice Department has indicated it will simply ignore them.

But the Speaker has received mixed messages from the Democratic caucus, and "insiders" tell Politico that the citations do not currently have enough support to pass right now.

"When we have the votes, we'll go ahead with this," a House Democratic insider, speaking anonymously, told Politico. "Right now, the votes are just not there."

Wexler Calls For Cheney's Impeachment

Rep. Robert Wexler (D-Fla.) is urging the House Judiciary Committee to begin impeachment hearings against Vice President Dick Cheney, despite opposition from House Democratic leaders.

Wexler, who first gained national attention for defending former President Bill Clinton during his impeachment in 1998, said Cheney has to be ousted in order to restore the balance of power between the executive and legislative branches, which in his view, has been eroded by an ever-expanding claim of authority under Cheney and President Bush.

"There's a litany of issues that need to be heard," Wexler said. "This administration has abused the power of executive privilege. This administration has completely avoided testifying before Congress on any one of a host of six, seven, eight issues.

“Whether we are talking about the manipulation of intelligence on Iraq,” he went on, “whether we are talking about the outing of a covert CIA agent, whether we're talking about the illegal use of torture, whether we're talking about the potentially unlawful firing of U.S. prosecutors - on all of these issues, the administration has thus far successfully used the power of executive privilege."

But impeachment hearings would be different, Wexler said, since the White House could not raise a privilege claim in order to avoid answering questions from lawmakers.

"In an impeachment hearing, the administration does not have the power of executive privilege," Wexler said, noting that the secret tapes that helped bring down President Richard Nixon did not surface until the House Judiciary Committee began impeachment hearings.

The House voted on Nov. 6 on a resolution by Rep. Dennis Kucinich (D-Ohio) to bring articles of impeachment against Cheney for pushing for the 2003 invasion of Iraq, repeatedly suggesting that there ties between al Qaeda and the late Iraqi President Saddam Hussein and advocating military action to overthrow Iran.

When Republicans, in a bid to embarrass House Speaker Nancy Pelosi and other Democratic leaders, voted for the measure, the House was thrown into a brief deadlock. The measure was eventually approved and sent to the Judiciary Committee, where Chairman John Conyers Jr. (D-Mich.) has declined to take action, despite pressure from Wexler and liberal activists outside Congress.
